Robert Powell gets 18 months in jail

The point I have been making since this broke is the Judges were corrupt but somebody was paying them off. As far as I'm concerned Powell and Robert Mericle are just as guilty as the Juvie Bothers Michael Conahan and Mark Ciavarella and they deserve the same punishment. Michael Toole also went down because of his association with Powell.

Some kid that sold a bag of pot to a friend that turned out to be "confidential informant" gets more time.

Pizzella sentenced to a Time Out




Another house arrest for an admitted criminal. I hate to bash a judge because you never know when you might end up in front of one but this sentence is ridiculous.

CV: U.S. District Judge James M. Munley ordered Pizzella to serve two years of probation, including five months on house arrest, after a federal prosecutor detailed Pizzella's cooperation in at least seven different investigations. Pizzella must also pay a $10,000 fine.

Pizzella has been singing to the FBI ratting out fellow Wilkes-Barre Area School Board members Brian Dunn and James Height and has provided information about the carpet guy plus the overcharging by Intellecom. The TL story says he was feeding the FBI information about Luzerne County Judges when he was Ann Lokuta's tipstaff.

His attorney conceded Pizzella “can in some respects annoy people” by being brusque. That is an understatement. Judge Munley cited Pizzella's cooperation and "spotless reputation" in deciding not to send him to jail.

Spotless reputation? Are we talking about the same person?


Pizzella, a former Plains Township police officer and township commissioner, has been accused of spousal abuse, punching his father and threatening to kill his daughter. In 1980, police accused Pizzella and a friend of hiring a hitman to break the legs of a political rival.


Pizzella also claims he is in poor health. It seems to be a problem with all the people who have snared in probe here in Corruption Junction. Judge Toole also claims he has a bad back, it must be contageous.


Judge Munley said: “We condemn the conduct. What he was engaged in is outrageous. It’s a throwback” to days when public officials routinely behaved that way, “and it will not be tolerated any more.”


If you don't put people in jail what is the deterrent Judge Munley?


On background I have been told that Frankie Kneecaps will not be allowed to watch Nickelodeon or The Disney Channel while he spends the next 5 months sitting on his duff. As an additional punishment he won't get a graham cracker after recess or a chocolate milk.

20 and counting

To no one's surprise Luzerne County Judge Michael Toole has copped a plea. We have speculating about this since last spring and it was just a matter of time after he announced that he was taking a vacation 2 weeks ago.


WILKES-BARRE - Luzerne County Judge Michael Toole has agreed to plead guilty to federal charges of honest services fraud and filing a false income tax return, the U.S. Attorney's office announced today.

CV: The U.S. Attorney's Office alleged Toole ruled in the unnamed attorney's favor in a case involving a vehicle insurance arbitration. Toole is also accused of concealing a $30,000 cash referral fee in 2006 and failing to report it on his tax return.

Luzerne County Courthouse happenings

Luzerne County Human Resources Director Doug Richards resigned effective December 4th then was fired because he wouldn't spill the beans to Maryanne Petrilla about a dodgy contract with a New York temp agency that doesn't seem to have an address. The Feds raided his office after he was escorted out of the courthouse but tried to take records with him before he left the building.


Judge Michael Toole has unexpectedly decided to take a vacation for a few weeks. That's a bit odd because President Judge Chester Muroski is screaming for help to clear the backlog of cases because the bench has been short a few judges the last year or so. Maybe he just needs a break and it has nothing to do with all the rumors swirlling around him the last few months. Florida is nice this time of year for a boat ride after you get there on a private jet. It looks like like Chet has help on the way because Ann Lokuta will soon be restored to the Court.



A first. Former superintendent of the Pittston Area School District pleaded guilty to taking a $5,000 bribe for helping a contractor obtain work in the district and was sentenced to 13 months in prison reported to the Fort Dix federal correctional institution in New Jersey. The poor bastard, I wouldn't wish anyone having to spend time in New Jersey no matter what they did.

Juvie Brothers update

A lawyer who defends himself has a fool for a client-Anon


CV: Following the penny-pinching lead of his partner in corruption, disgraced former Luzerne County Judge Michael T. Conahan will start representing himself in a series of kids-for-cash civil lawsuits, his departing attorney, Philip Gelso said.


His partner in crime, Mark Ciavarella, has also taken over his own defense of the lawsuits. The recent WNEP interview with him happened as he was leaving the Federal Courthouse in Scranton after he filed a motion to dismiss a civil lawsuit against him. That interview (and other things) seems to have pissed off Judge Kosik who rejected the plea agreements.


In other Juvie Brothers news the Feds are now looking at their bar bills...The agents showed up at the 113-year-old Hanover Township club two or three months ago to review the bar bills of Judge Michael T. Toole, former Judge Mark A. Ciavarella Jr. and school board member Brian F. Dunn, country club accountant Bob Anderson said in a phone interview.

It's about more than the kids

The Legal Intelligencer has a devastating story about the Juvie Brother's that details their misconduct that goes beyond the Cash for Kid's scandal saying that was just the tip of the iceberg and only the most blatant example of the corruption overseen by the two judges. In addition to Billy D'Elia former Judge Michael Conahan had a long history of links to organized crime figures. A lifelong friend of Conahan's, Tom Pendergast, said that he set him up with no show and delivery jobs that he was nervous about taking and walked away from the extra "work."


It also goes into the allegations of case fixing of auto accidents and tax assessment cases involving Bob Mericle. In addition, as The Legal first reported in March, multiple sources have said the federal government is investigating whether Luzerne County Common Pleas Court Judge Michael Toole allegedly took a payment from Powell.

It also identifies Conahan's cousin Bill Sharkey as the "bagman" who would collect the "finder's fee" from local attorneys after a favorable judgement.


And former Controller Steve Flood was the object of Conahan's ire.


Flood, according to Stretton, attended a party after his election to the controller's office in 2001 with other political types. Conahan was there, Stretton said Flood had told him, and so was at least one prominent attorney from the area.

At one point, Conahan saw the attorney, Stretton said, relaying Flood's story.

"Conahan turned to the lawyer and said, 'Hey ... how about that $10,000 you owe me for the settlement last week,'" Stretton said Flood told him.

"That's what got him suspicious about these guys," Stretton said. "He walked out and, after that, they became adversaries."

Another source said Flood related the same story.

Four years later, in 2005, while Flood was running a re-election campaign, he and Stretton were sitting together when the phone rang.

Flood answered.

A prominent attorney from a major firm was on the other line.

"Conahan just called and said if we give one penny to your campaign, we'll never win another case in the county again," Stretton recalled the attorney telling Flood.

Marino testifies

SCRANTON – Luzerne County Judge Michael Toole’s tipstaff Tom Marino testified for more than 1 hour Tuesday before a federal grand jury investigating corruption within the county.

He was issued a subpoena on June 1. The Feds are looking into money Participant 1 Robert Powell paid to Toole. Zen says it was $82,000 for his services for refusing to rule on subpoenas issued by then Controller Steve Flood when he was looking into the county contract with PA Child Care in 2005 then owned by Powell and Greg Zappala. Toole could have ruled against the subpoenas, but that would have given Flood a chance to appeal to get the subpoenas enforced. Toole was also a guest at the Juvie Brothers Florida condo least once and also ruled on a dispute involving Robert Powell's yacht.


Prosecutors say Powell knew that Conahan and Ciavarella were committing a crime when they accepted the kickbacks from Powell and local developer Participant 2 Robert Mericle, but failed to report it. He also helped the judges disguise the source of the money he and Mericle paid.

No pension for you

Two ex-judges denied pensions


Former Luzerne County judges Mark Ciavarella and Michael Conahan are not entitled to their pensions and could be liable to reimburse the state $4.3 million for higher juvenile placement costs it says are tied to the kickback scheme the jurists engaged in, the State Employees’ Retirement System has determined.


Conahan has been collecting 8 grand a month since he retired and Ciavarella was slated to get over $5K but has not received any payments. Ciavarella also tried to cash out his contributions after he was charged but the state pension fund refused his request. Conahan's timing was better and got a lump sum payment of $302,777.09.

And the assertion of Robert Powell that he was strong armed into paying the Juvie Brothers all that money in bribes is laughable. They also forced him to invest in the real estate deal with them and Jill Moran in Mountaintop. The fact that Powell was wearing a wire after the Feds pinched him hit the papers this week and I'm sure that my faithful readers will remember that was first reported on this blog in January.

Bad company

Luzerne County Judge Michael Toole's Tipstaff Tom Marino got a subpoena on Monday.


Participant 1 in the Juvie Brothers scandal, Robert Powell, payed some cash to Toole for unspecified reasons according to Terrie Morgan-Besecker in the TL. Why would Powell possibly give money to Toole ? Let me get out my crayon.

Or it could have been for something else.

In other news the Juvie Brothers are still free to travel back and forth to the condo in Florida and may not be sentenced for some time.

Toole out

A lot of conflicting information has been coming out of the Courthouse about Judge Michael Toole. I'm hearing that he has resigned his position and we can expect another US Attorney press confrence on Monday complete with an idictment and plea agreement.

Norton says I'm wrong. But if doesn't happen this week it's only a matter of time.

Et tu, Toole

Zen is reporting that another Luzerne County Judge may be in hot water.


The Legal Intelligencer says Federal authorities are looking at Luzerne County Common Pleas Judge Michael Toole in today's edition. I don't have a subscription (yet) but you can read the whole article at Sights on Pennsylvania.

Toole could have ruled against the subpoenas, but that would have given Flood a chance to appeal to get the subpoenas enforced. Toole was also a guest at the Juvie Brothers Florida condo least once and also ruled on a dispute involving Participant one's, Robert Powell, yacht. Why a PA Judge would be ruling on a dispute in Florida is a good question.

Juvie brothers update

There are now 3 class action lawsuits on behalf of the children who were the victims of Judges Michael Conahan and Mark Ciavarella who railroaded them through the juvinile justice system. The suits says the judges and other defendants conspired to perpetrate "what ranks as one of the largest and most serious violations of children's rights in the history of the American legal system.



Luzerne County President Judge Chet Muroski confirmed that the probe involves more than the PA Child Care investigation. This thing is expanding into allegations that civil cases were being fixed.



Judges Peter Paul Olszewski and Michael Toole have been interviewed by the FBI and we wonder if their stays at the condo in Florida has any thing to do with the feds interest.

Luzerne County Prothonotary Jill Moran is playing "Lets make a Deal" claiming that some people allegedly attempted, without Moran’s "full knowledge and consent, to use Moran to facilitate frauds.” Mark Guydish in the TL doesn't buy it. Moran has always claimed to be the unintentional political puppet, not the puppeteer; the piece being played, not the player. It’s a role she took on again this week with the deal struck in the federal courthouse investigation. She didn’t commit fraud, she was used by those committing it. She is the head of the W-Cat company that was suppossed to be building houses in Mountaintop. Some of her partners were the the Juvie Brother Judges and her law partner Robert Powell plus some people that I know that are going to be hurt .


Conahan's cousin Bill Sharkey was officially fired after pleading guilty to stealing more than $70,000 of seized gambling money over 10 years. He stopped reporting to his courthouse job on Aug. 20, a day after federal agents served a subpoena on his office for records connected to money seized in illegal gambling cases. During his leave from work, Sharkey maintained possession of a county vehicle and county mobile phone. Ciavarella approved the paid leave of absence for Sharkey. Who the hell is in charge, if anyone, of keeping track of county vehicles?

Conahan's brother in law millionaire psychologist Dr. Frank Vita and forger Sandra M. Brulo are also in trouble.
