Luzerne County finances

I started off blogging about Luzerne County government and politics but haven't written much about it lately. The Yonk  reminded me that I was a unrelenting critic of the games that the Bond Brothers played with numbers that put our county into the hole that it is in. Thankfully convicted criminal Greg Skrepnak and Todd Vonderheid are no longer Commissioners.

As a result of the Juvie Brothers and other scandals the people decided it was time to change the form of government and passed Home Rule. The new county council hired a professional manager after a nationwide search. This new form of government is not perfect but it is a big improvement over the old system of 3 Commissioners and a myriad of elected row officers.

Luzerne County Manager Bob Lawton is getting high marks from the people I have spoke to in county government. He is trying to clean up the mess. I don't agree with all his decisions on some non budget issues such as firing Leonard Piazza as Director of the Election Bureau.

Some of the dead enders will still try to hang on.

4 seats on the new county council will be up in 2013. I urge all interested candidates to attend Blogfest on September 21st to give your pitch.  The Controller's spot is also up and the only name I've heard on the Dem side is Bob Morgan. Incumbent Walter Griffith is definitely running for reelection.

Cartwright hits Holden ON THE ISSUES

Tim Holden has aired 2 TV spots going after Matt Cartwright about things that have nothing to do with the duties of a member of Congress. One was tapping into the emotions of the Kids for Cash or as I call it the Juvie Brothers scandal that worked very well in the last DA's race. Cartwright gave money to Conahan and Ciavarella just like many lawyers did well before we knew how evil they were. Another argument to choose judge's on merit but that is another post. The second said you should vote against him because he is well off financially, really. Maybe Matt should bring that boat north and park it at the slip in Nesbitt Park and rename it "Hung Jury."

Yesterday Cartwright started airing what is called in the business a contrast ad but it doesn't attack Holden personally but objects some of the votes he has cast.

Tim Holden voted no on the Affordable Care Act. The most important piece of social legislation that every Democratic President since Harry Truman has been trying to achieve. It's not perfect but it is a start. I don't know how someone can call themselves a Democrat then vote against denying health care coverage for 30+ million of people. Then there is the Haliburton loophole that just may poison all of our water.

Tim Holden is grasping at straws. After going after Matt Cartwright because he gave some money to the Juvie Brothers his hired gun Joe Trippi thinks that being successful in life is a liability. The spot also takes something Cartwright said way out of context. Do Holden and Trippi think that they can get away with lieing like Mitt Romney without being called out on it?

Congressman Tim Holden put a poll in the field last week that has apparently shown he is in real trouble. I haven't seen the numbers but judging by the reaction of the Holden camp they have gone into panic pass mode.

Hired gun Campaign Manager Joe Trippi who's claim to fame was the 2004 Howard Dean Presidential campaign has put out one of the most dishonest ads I've seen tying Cartwright to the juvie brothers scandal because he gave some money to Callahan and Ciavarella years before the 'kids for cash scandal' broke. It's interesting that the successor group of the Dean campaign, Democracy for America, has endorsed Cartwright.

Joe has to make a living and this line of attack helped Stefanie Salavantis become the Luzerne County District Attorney so he has some good local researchers. We will see how that works out.
So Cartwright gave $1375 to Ciavarella's retention effort just like many other lawyers which raises the question should judge's be elected or appointed after a vetting process. Judges on Merit has more to say on this subject. Conahan may not have been selected after a background check.


Instead of what is going out we should take a look at what is coming in.

Holden, a Blue Dog has taken $688,999 from the finance industry and $414,997 from Big Oil and Gas. Holden has taken even more money from AgriBusiness and he's scooping up checks like mad this year to fight off his first serious electoral challenge ever. [One of the company's eager to keep Holden in Congress is AT&T, which has given House Republicans $896,121 thisyear and House Democrats $443,750. $5,000 of that went to Holden.

The Pennsylvania Progressive tells us about Holden's voting record:

He did not vote for the Affordable Care Act, voted against organized labor, for wars and their funding, for the National Defense Authorization Act, for the PATRIOT Act, FISA wiretapping and against homeowners trying to avoid foreclosure.

In the wake of the scandal, Matt Cartwright spearheaded the Juvenile Defense Lawyer Project in Luzerne County to ensure that juveniles were treated fairly by the courts and judges. In fact, in a Times-Leader article on June 11, 2010, Cartwright was “recognized for his leadership of the Juvenile Pro Bono Defense Program, which was created to guarantee pro bono counsel for juveniles that had been adjudicated by former President Judge Mark Ciavarella in the event their cases were retried.”
If anything, Matt Cartwright was a hero in cleaning up the criminal mess that these judges created.
“Tim Holden spent the past 20 years in Washington, and this is what he decided to talk about,” said Cartwright. “Of course, it is not surprising that Holden does not want to discuss the facts that he voted to create the Halliburton Loophole and against Health Care Reform. Further, in 2001 and in 2002 he voted with President George W. Bush more than any other Democratic member of Pennsylvania’s Congressional Delegation.”
Matt Cartwright is a Democrat, running for Congress in the 17th Congressional District, which now includes parts of Carbon, Lackawanna, Luzerne, Monroe and Northampton Counties, as well as all of Schuylkill County. Luzerne County Council to hire a manager

The papers are reporting that a guy from California will be offered the job as the first Luzerne County manager under home rule later today. The CV and the TL say the pick is Robert Lawton. I don't know much about him other than what I read in papers but certainly wish him the best. He is walking into a mess of a budget situation left over by former Commissioners Maryanne Petrilla, Steve Urban and the other guy that interim manager Tom Pribula has been trying to address. He keeps proposing a mix of tax increases and budget cuts that the new council keeps shooting down. Sounds a lot like what is going on in Washington.

I have been getting beat up in the comments and other blogs for my backing of the new form of government. It's a school board, it won't work, etc. The new charter is not perfect but then what is? I preferred the previous charter with an elected county executive and a mix of distict and at-large elections for the council. That plan was shot down when Skrep and Vondy said "trust us." That worked out well.

This new form of government was passed as a reaction to the Juvie Brothers scandal for sure. The thing I like about it was elimination of most of the row offices that were power centers with no oversight. How many of them went to jail? There is no Democratic or Republican way to perform an autopsy (Coronor) or to register a will. And What the hell is a Prothonotary?

If they hire Lawton and he doesn't back out before February 21st the Yonk has some advice. A couple of my favs

Luzerne County DA

The hottest race this cycle has unexpectedly been the contest for Luzerne County District Attorney. In the spring incumbent Jackie Musto Carroll looked like a shoe in without a primary opponent and no Republican had circulated nominating petitions. She even mounted a write-in campaign trying to also snag the Republican nomination but Stepahanie Salavantis got into it at the last minute and secured enough write-in votes to become the Republican nominee. Like most political junkies I hate uncontested elections and welcomed her entry, I always like a choice in an election.

To the surprise of most political observers Salavantis is running hard spending some big bucks on radio and TV ads. Her campaign finance reports show that she has received some financial support from individual donors but most of her money has come from her parents. Carroll also got money from her folks but not as much. I didn't find the name of her Uncle Ray in any of the reports.

Stephie Sal has had 3 spots on TV so far trying to tie Jackie Mo to the Juvie Brothers (cash for kids) scandal implying she could have somehow prevented or stopped it. DA Jackie Mo is not on the air yet that I have seen but I'm told that will change shortly. She has hired local legend Ed Mitchell to do her media.

Luzerne County Judges

We will be electing 6 new Judges of the Luzerne County Court of Common Pleas next month. There are 7 candidates and I have met 6 of them. They are all good people that will replace the disgraced Juvie Brothers Conahan and Ciavarella. LuLac tells about them: These convicted Judges were sneaky, conniving, vindictive, powerful and ruthless bastards. Ask a former Judge named Lokuta. I don't want to open the whole Lokuta thing again but me and the Yonk agree that she was fucked over by Conahan and the Judicial Conduct Board that had a few of his acquaintances sitting in judgement of her. She was not convicted of a crime and probably deserved a kick in pants but overturning an election is extreme.


5 of the 7 candidates secured the nomination of both the Democratic and Republican party's in May. I hate cross filing for Judge and School Board because these are political positions and we should decide in the general election not the primary. The convential wisdom is that the 5 who got double nominations will win although anything can happen. That's why we have elections.

That leaves the odd man (person) out. The race for the 6th spot is between Rebublican Dick Hughes and Dem Molly Mirabito

This is a tough call for me. I have had a few discussions with Hughes and Molly. They both came to Blogfest and the lawyers I know highly recommended them both.

My solution to this delimma is to bullet vote for Mirabito and Hughes.

Predictions: 119th, 120th and 116th State Rep races.

In the overwhelmingly Democratic 119th District I expect the Democrat to win the race to succeed John Yudichak. Gerald Mullary had a rally with Yuddy on Friday night that should seal the deal. Republican Rick Arnold has run a great campaign but I don't think he can overcome the registration numbers and Libertarian Brian Bergman will drain votes away from him.


The 120th race has been my favorite this cycle as I have got to know and like all 3 candidates. But then I am like the Will Rogers of the local blogosphere and all 3 have mixed it up in the comments of this blog. The story in this race is the Libertarian candidate Tim Mullen who got 2700+ signatures on his nominating petitions and has had enough financial support to open an office in Kingston. I don't remember a local 3rd party candidate ever being taken this serious. That being said Phyllis Mundy will be reelected and the real race is who will finish second.


State House Democratic leader Todd Eachus has been beat up pretty good over his rides on Robert Powell's jet this last week and his one TV spot attacks Tarah Toohill for her connections to the juvie brothers. He is worried. I think Eachus will hold on but this could be the surprise of the night. Got to love this spot that forced Eachus into a debate.

Corruption Junction

A few months ago Capitol Ideas referred to Northeatern Pennsylvania region as "insanity with borders" when talking about all the scandals that have surfaced. Hard to argue with that but it's not exactly a catchy phrase.

I came up with the Juvie Brothers to describe the evil that Judges Michael Conahan and Mark Ciavarella engaged in but the papers settled on "cash for kids." I can't argue with that, at least the scandal hasn't been tagged as some sort of -gate, such as bonusgate. That is just lazy.

So I propose that the ongoing corruption investigation outside of the Juvienile probe in Luzerne/Lackawanna counties be dubbed Corruption Junction.

If you can up with something better you will win a Gort42 hat.

I can't say that I agree with this but it is state rankings not by county. Those of us that live here in Corruption Junction (Luzerne County) know better.


Website ranks Pennsylvania among top 10 corrupt states

The Daily Beast is using old data from just Philadelphia and doesn't take into account our own Juvie Brothers and the rest of the cast of characters of school board directors and municipal officials not to mention the Bonusgate corruption in Harrisburg.

I will have to slip an envelope to Sights on Pennsylvania for pointing out this story. I'll stuff it with 10% of my ad revenue.

10th CD Republicans

At this point in the 2008 race for the Republican nomination for Congress in the PA 10th District between Chris Hackett and Dan Meuser was a slugfest. Both candidates were running TV ads ripping into the other using information that I'm proud to say was first reported on Gort42 in many cases. This time around it's down right tame, even dull. That probably is due to the fact the candidates this time are not millionaires willing to pump a chunk of their fortunes into the campaign.

The conventional wisdom is that a freshman congressman is most vulnerable in the next election. But the national trend combined with the primary bloodbath that left many Meuser supporters resentful saw Congressman Chris Carney reelected by a big margin (56%-44%).

This year the Republicans have convinced themselves that Health Care Reform is so unpopular with people that think like them and live in the same echo chamber that he is a goner. I think the economy will be a bigger issue in the fall as it always is in any federal election.

All 3 GOP hopefuls oppose HCR and rail against deficits yet propose even more tax cuts. I call them the Tax Cut Triplets.

Malcolm Derk will not be on the air anytime soon. He is the first to file a FEC report showing that he only raised $18,000 in the first quarter with just $11,000 cash on hand. A few days ago his campaign sent out a press release that said he will be touring all 14 counties in the district. That sounds nice but it didn't bother to tell us where he will be and when.

Dave Madeira has the best website of the 3 with a full calendar of events plus all his press releases. and much more. He is planning a really neat event on 235th ANNIVERSARY OF PAUL REVERE'S FAMOUS RIDE . He will be riding a motorcycle across the district and tells us where to find him.

The ride will start at 12:30 p.m. in Shamokin and make stops in Muncy, Dushore and Tunkhannock before ending in Honesdale at 5:30 p.m. The 165-mile ride will go through Northumberland, Snyder, Union, Lycoming, Sullivan, Wyoming, Lackawanna and Wayne counties.

I hope he wears a helmet or at least a tri corn hat. This is kind of like teabaggers meet the Hell's Angels.

Tom Marino made a typo on his financial dislosure report. Louis DeNaples paid him a quarter of million dollars not $25,000. He defends writing a reference for DeNaples when he was applying for a slots license saying



"Mr. DeNaples has been a friend of mine for a long time," Marino said. "He's been very good to this state. He's created thousands and thousands of jobs, and I'm not throwing Mr. DeNaples under the bus for vote."

DeNaples was later indicted for lying on his application but the charges were dismissed. Marino also claims he started the investigation into the Juvie Brothers corruption scandal in Luzerne County when he was the US Attorney.

Conservative website REDSTATE is not a fan of Marino.


Meet Tom Marino, who will certainly be in the DCCC’s crosshairs if he wins the GOP primary in Pennsylvania’s 10th to go up against Rep. Chris Carney (proud member of the Stupak Sellout crowd instrumental in voting ObamaCare into law last week). Marino, a former US Attorney, has his own shady dealings which will make for good campaign fodder in the general.

During Marino’s tenure as US Attorney, local businessman Louis DeNaples was under investigation by the US Attorney’s Office for his ties to William D’Elia, head of the Bufalino crime family. It seems DeNaples lied about his relationship with D’Elia to the Pennsylvania Gaming Control Board when applying for a licence for the Mount Airy Casino. Listed as a personal reference on that same application was none other than US Attorney Tom Marino, the very man running the office investigating DeNaples’ organized crime ties.

The Department of Justice got wind of the conflict of interest and ordered Marino off the investigation, and shortly after the media broke the story he resigned his post… and went to work for Louis DeNaples. (The charges were eventually dropped when DeNaples agreed to place the casino project in the name of a family member.)

The reality is just as bad as–if not worse than–the optics of this scandal. Do we really want someone like Marino representing the GOP in what will be a battleground district this fall? Rep. Carney, the Pelosi-enabling, abortion-funding “Blue Dog” Democrat from a conservative district in northeastern Pennsylvania will have a hay day with Marino’s record. I’ve spoken with people in the district who feel uneasy about Marino and will likely just stay at home rather than having to choose between him and Carney.

One of the keys to a Republican resurgence is not only ensuring we have credibly conservative candidates running for office, but also candidates with a personal and professional record we can be proud of and defend. Tom Marino doesn’t fit the bill.

Yuddy on the air

John Yudichak is the first candidate in the State Senate 14th District race to start running a TV ad. Expect his Democratic rival Tom Leighton to follow shortly. Steve Urban is the only Republican on the ballot so I don't expect him to spend any money in this race until the fall unless he somehow gets the nod for Lt. Governor. Libertarian Betsy Summers has a big hill to climb just to get on the ballot.


The spot mixes pictures of his family with headlines that extol his virtues in opposing the pay raise and pension increase and smacks the Juvie Brothers. That's a lot to fit into 30 seconds. His YouTube channel also has another 30 second web ad and his announcement speech. The Yonk has a review.

Would you loan this guy money?

This one has me shaking my head. Former Judge Mark Ciavarella defaulted on a loan from a bank in Minersville. You have to wonder why a bank would approve a loan to an unemployed person under federal indictment who is a defendant in multi-million dollar civil lawsuits that had previously defaulted on a business loan from Louis DeNaples bank. Miners Bank had previously been used to pay the bribes from Robert Powell and Bob Mericle to the Juvie Brothers.

Scooch and his fellow defendant Michael Conahan filed a bunch of motions last week to delay their eventual trial alleging a violation of attorney client privilege, asking for new Judge and a change of venue.

Man of the Year

The former United States Attorney for the Middle District of Pennsylvania was recently honored as "Government Lawyer of the Year" by the Pennsylvania Bar Association. His leadership of investigators from the FBI, IRS and other government agencies resulted in blowing the lid off of many of the criminal practices that have been normal in Luzerne County for as long as I can remember such as job selling and kickbacks for contracts. That is a set of crimes that would have not been possible to bring to light without the uncovering of the Juvie Brothers scheme of selling kids up the river. He is a career prosecutor who has been promoted to U.S. magistrate judge in Harrisburg, Pa and was succeeded in the office by Dennis Pfannenschmidt
who has continued the investigation. Mr Pfannenschmidt will be busy in 2010.

The Times-Leader named Luzerne County President Judge Chet Muroski Person of the Year. I can agree that Muroski has done many things to try to clean up this mess and restore trust in the courts but I can't get by the question of why it took so long. Talk of something being remiss in the courts has been out there for a long time. So far 3 judges have gone down with the rumor that a 4th will soon be charged. Let me ask you this, if you had a criminal or legal matter pending would you want your case heard in a Luzerne County Court?

Best Scandal -- Local Venue

Judges Mark Ciavarella and Michael Conahan not only took kick-backs for sending kids to a private juvenile prison facility where the state or local communities had to pay top dollar to house young delinquents but they sent kids to jail for the pettiest of offenses, good kids who had made minor mistakes, kids who had no business being sent to prison. A few examples make the point: as in their sentencing a 17-year-old for five months because he helped a friend shop lift a DVD from a Wal-Mart; sending a 15-year-old off for three months in their co-conspirators' juvenile camp for mocking a school official on a MySpace page; sentencing a 13-year-old weekend confinement for trespassing in a vacant building - the list is long but you get the gist. These two judges earned not less that $2.6 million running this kickback racket while ruining young lives for their own illicit gain before they were caught red-handed. For me, this local scandal pales all others nominees.

Who wants to be a Commissioner?

With the sudden but not unexpected resignation of Greg Skrepenak there is an vacancy on the Luzerne County Board of Commissioners. So far a dozen people have applied for the job and the deadline to apply is Monday. The Times-Leader has a list of the applicants with a short bio listing their qualifications. I know some of the names on the list but suspect that the eventual winner will file the paperwork at the last minute.

Former Commssioner Frank Trinisewski and recent Controller candidate Bob Morgan are at the top of the list. I have heard a few other names mentioned but will wait until tomorrow to see who applies. One of our local bloggers has thrown his satirical hat in the ring.


The Luzerne County Judges will meet en banc on Wednesday to pick the eventual victim, I mean new Commissioner. Whoever they pick will serve out the rest of the 2 years remaining of Skrep's term. If there was ever an argument for Home Rule this is it. Such a decision should not be in the hands of the most discredited bunch of people in the county. The Sargent Shultz routine ( "I know nothing)" about the Juvie Brothers scandal is just not credible.

Update: The Luzerne County Courts website now lists over 60 people applying for the post. The deadline in 4PM today.

New row officers staff up

As first reported by Mark Luzerne County Controller-elect Walter Griffith
has selected Frank Pinnacoli to be deputy controller and Thomas Mosca as his new solicitor.

Pinnacoli has a BA in accounting from Kings College and has had a number of jobs the last few years. Price Waterhouse Coopers in New York City, CTSI in Dallas Acton Technologies Inc. in Pittston , Pella Products Inc. in Dunmore. Pinnacoli currently owns NEPA Accounting & Consulting Inc. in Kingston, a business he started with his father.

He replaces acting Controller AJ Martinelli who has to answer questions about his involvement with former Human Resources Director Doug Richards and the Continental Consultants Group. Earlier this year the Citizens Voice had a story about the no bid contract with Continental Consultants and I wrote about it in January. Not even the Commissioners knew what is going on let alone our clueless former Controller and present Commissioner Chairwoman. Why it took 10 months to expose this fraud is something all 3 commissioners and the acting controller have to answer for when all the information was in the public record. This should have been addressed long before the FBI had to figure it out for them. Martinelli also made the Idiot Watch with his spectacular pants falling down “Give me a break” DUI arrest performance.


Sam Stretton will be the solicitor when Carolee Medico Olenginski returns to the Luzerne County Prothonotary’s Office in January. Stretton was her solicitor the first time she held the office and later was the solicitor for former Controller Steve Flood who first blew the whistle on the Juvie Brothers and the 20 year lease of PA Child Care "negotiated" by the Bond Brothers. Primary Controller candidate Bob Sypniewski will be her deputy. Bob has previously said he would put his business interest on the back burner and work full time for the county.

Carolee has yet to name her interior decorator.

One and done

I had a great conversation a few days ago with an old Air Force pal who is now an assistant US Attorney in another part of the country. He couldn't comment on what is going on around here but told me how the Department of Justice deals with public corruption cases. The first goal is to get the crook out of office and by the time someone gets a target letter their goose is cooked. To get the offender out of office and avoid a long expensive trial a deal is offered. Plead guilty to one charge, resign your office and go to jail for a short time or we will take it to trial and hit you with a list of charges that you know that you are guilty of and spend more time behind bars. This works as long as the judge is willing to go along with it.

A case in point. The Juvie Brothers, Michael Conahan and Mark Ciavarella, agreed to to plead guilty to 2 charges in exchange for a 7 year sentence. Federal Judge Ed Kosik rejected the plea and a 48 count indictment was then filed by the US Attorney. It will take some time to bring this to trial.

On earlier threads some commenter's defended a few of our local crooks saying taking some clothes or travel money was no big deal if that was the only thing they did. What else did they do? The feds know.

Luzerne County Judges Thomas Burke and Peter Paul Olszewski Jr. are up for retention to the Court of Common Pleas this year and they are feeling the heat of the fallout of the Juvie Brothers scandal that may result in them losing the yes/no vote. They may meet a similar fate as Pennsylvania Supreme Court Justice Russell Nigro? In 2005 Nigro lost his bid for retention because the state legislature voted themselves an outrageous pay raise in the middle of the night and the voters took their wrath out on him. They have not been accused of any wrongdoing but Conahan and Ciavarella are not on the ballot and they are. People I talk to are in a throw the bums out mood.

PPO-2 has been in full campaign mode with a website up and has been raising money. Judge Burke hasn't raised a dime, doesn't have a website but has been pressing the flesh asking people for their vote and answering every question thrown at him.

Olszewski’s trip to the Florida condo has been well documented and just may sink him. I've never heard anybody say a bad thing about Judge Burke and I even had him for jury duty recently and thought he was very fair. Then again I had Ciavarella for jury duty a few years ago and was impressed by him. Shows what I know. But I just can't get by this from a local attorney:

Olszewski and Burke claim they did nothing wrong. "It wasn't me, It was them. I didn't know. How could I know?" Just men had a duty to discover the truth. Olszewski said the hearings took place a half a mile away in another building. How could he hear? How did an advocacy group over 100 miles away in Philadelphia hear enough to file lawsuits on behalf of more than 500 children? How did the FBI know enough about it to raid juvenile probation? Olszewski says if he knew he would have told the FBI. If "ifs" and "buts" were candy and nuts, oh what a party we'd have.

I always vote no on these questions no matter what is going on but that's just me and all my Republican friends tell me I'm wrong to vote no on Burke. As unfair as it may seem to be to these gentleman ( I doubt their judgement and tin ears not their integrity) we have to send a message about what has been going on in the Courthouse and the way to do that is to vote no on retention.

Luzerne County Judges

The headline election this year is the election of 2 new Judges for the Court of Common Pleas. After the revelations that the Juvie brothers, Michael Conahan and Mark Ciavarella, have taken public corruption to a level unseen anywhere in history of this country the choice is especially important. Taking a bribe to fix a case seems almost pedestrian (they did that too) but designing a scheme to conspire to build a private juvenile penal colony then railroading children through the court system to ensure the place makes money is beyond corrupt, it is evil. And they had lot's of help.


17 candidates ran in the primary and now we have the choice of 3 very qualified people to fill the 2 open seats. Wilkes-Barre district judge Bill Amesbury won both nominations which in past years would assure his election because his name would appear twice on the old lever machine ballots but with the new touch screens he will only be listed once. Tina Gartley has been running the most energetic campaign and has been all over the place and her online outreach has been impressive, I think John Dawe knows how to work the intertubes. Republican Dick Hughes has solid support from the local GOP and many Democrats and independents that I talk to also like him.

My prediction is that Gartley will be top vote getter with Amesbury and Hughes fighting it out for the second spot. Some Hughes supporters are urging a bullet vote for him. A bullet vote is casting a vote for just one candidate when you are allowed to vote for more than one. In this case you can vote for two.

PA State Supreme Court race

I don't pay much attention to the statewide Judge races because the candidates run on their bio's and promise to be tough on crime with an emphasis on locking up all the drug dealers. But then every politician promises to lock up all the druggies and we all know that policy has worked out well over the past 50 years. Their campaigns are financed by the lawyers that will appear before them but they assure us that that will not influence their rulings. What a bunch of hooey.



Pennsylvanians for Modern Courts make a good case for scrapping the present system and going with merit selection of Judges. Their blog JudgesOnMerit.org documents the problems with electing appellate Judges.



The Democratic nominee for the one open seat is Jack Panella
from Northampton County who presently serves on the Superior Court and was on the Court of Judicial Discipline that dropped the ball over the allegations about Luzerne County criminals Conahan and Ciavarella . They were busy with the Lokuta witchhunt orchestrated by Conahan.

His opponent is Joan Orie Melvin from Pittsburgh who also serves on the Superior Court. Her website tells us that she has been a lifelong Republican. Her faith is the cornerstone of her life. She comes from a family of nine children raised with the principles of God and Country. Her sister is State Senator Jane Orie who helped her get the endorsement of the Pennsylvania Teamsters that didn't turn out so well. The Pennsylvania Progressive has the details.

Melvin was in town last month and said of the Juvie Brothers scandal "This is surreal. It is right out of a Charles Dickens’ novel."

In her previous visit to Wilkes-Barre in May she gave a long rambling speech to the local GOP faithful. In that speech she listed as one of her selling points was the upcoming redistricting after the 2010 Census telling the partisan crowd that they needed a Republican on the court to rule in favor of Republicans in any challenges to whatever plan emerges.

So much for Judges being above politics.

Now Capitol Ideas points out that the state GOP is running a banner ad on GrassrootsPA on her behalf.

"Tired of Barack Obama, Ed Rendell, Arlen Specter and big government Democrats ruining our nation?" the advertisement asks in yellow block capitals set against a bright-red background. And in case the message wasn't subtle enough, there's a Soviet-era hammer-and-sickle inside the "O" in Obama's last name. That oughta rally the base, eh?

She's using a hammer and sickle for the "O" in Obama in her new web ad. Disgusting. And the best part is that it's paid for by the PA GOP.

Comparisons to Communists or Nazi's used to be out of bounds in American politics but the Tea Bagger crowd does it all the time and now it is somehow Okay. It's one thing for a bunch of people who are ignorant of history and political philosophy to engage in this kind of nonsense but a State Supreme Court candidate should know better.

The thing that we want in our Judges is to be impartial and not take political sides no matter what party they belong to. She flunks that test.
